18th & Vine Arts Festival 2025 Terms and Conditions for Artists
These Terms and Conditions ("Agreement") are entered into between the 18th & Vine Arts Festival Foundation ("Festival") and the Artist ("You") upon your application and acceptance to participate in the 18th & Vine Arts Festival 2025.
1. Application and Participation
1.1. Application Fee: A non-refundable fee of $30 is required for all applications unless you are aged 13-17, in which case the fee is waived and contact (816) 760-2278 by CALL OR TEXT.
1.2. Payment Deadline: For your application to be reviewed, the application fee must be paid in full at the time of submission.
1.3. Application Review: Submission of the application does not guarantee acceptance. All applications are subject to review by the Festival Selection Committee.
1.4. Acceptance Notification: Accepted artists will be notified by email and phone. The Festival can limit participation based on space, programming, or other considerations.
2. Artist Obligations
2.1. Performance and Exhibition:
You agree to showcase and/or perform your artwork, music, fashion, or other creative disciplines during the Festival dates.
All artists must be present during Festival hours:
Friday, September 26, 2025: 5:00 PM - 10:00 PM
Saturday, September 27, 2025: 10:00 AM - 10:00 PM
Sunday, September 28, 2025: 10:00 AM - 5:00 PM
2.2. Setup and Takedown:
Load-in times are strictly enforced. Load-in must be completed:
Friday: 2:00 PM - 3:00 PM
Saturday and Sunday: 8:00 AM - 9:00 AM
Artists are responsible for the timely removal of all equipment and artwork after the Festival.
2.3. Equipment and Materials:
Artists must provide their own tools, materials, and supplies, including tents, display stands, and payment systems.
If exhibiting outdoors, tents must be anchored with sandbags or equivalent stabilizers.
2.4. Insurance and Liability:
You are responsible for insuring your artwork against damage, theft, or loss. The Festival is not liable for any such occurrences.
The Festival will make reasonable efforts to provide a safe environment but does not guarantee protection from accidental damage or breakage.
2.5. Marketing and Promotion:
You agree to market your participation in the Festival on your social media platforms using the official hashtags:

A headshot, logo, and artist bio must be submitted by August 1, 2025, to Info@18thandvineartsfest.org.
2.6. Conduct:
You agree to conduct yourself professionally and comply with all instructions from Festival staff and volunteers.
Actions that damage the Festival's reputation or disrupt operations may result in removal without a refund.
3. Ownership and Copyright
3.1. Ownership: You retain ownership and copyright of your work unless sold to a buyer during the Festival.
3.2. Promotion Rights: The Festival reserves the right to photograph, film, or record your work for promotional purposes, with credit provided to you.
4. Fees and Sales
4.1. Sales and Transactions:
All sales transactions are the responsibility of the Artist, including collecting and remitting applicable taxes.
The Festival does not collect commissions on sales.
4.2. Refunds: Application fees are non-refundable, including cases of cancellation, withdrawal, or rejection.
5. Health and Safety
5.1. Compliance: You must comply with all applicable health and safety laws, including using approved equipment and adhering to safety protocols.
5.2. Illness and Emergency: Notify the Festival immediately if you are unable to participate due to illness or emergency.
6. Cancellations
6.1. Festival Cancellation: If the Festival is canceled due to unforeseen circumstances, you may apply your registration to the next Festival. No refunds will be provided.
6.2. Artist Cancellation: Withdrawal from the Festival after acceptance will result in forfeiture of your application fee.
7. Independent Contractor Status
7.1. You are not an employee of the Festival and are solely responsible for your taxes, insurance, and other financial obligations.
7.2. You indemnify the Festival against any claims related to taxes, injuries, or damages arising from your participation.
8. Disputes
8.1. Any disputes arising under these Terms and Conditions shall be resolved through arbitration in Kansas City, Missouri.
9. General Provisions
9.1. Amendments: Any modifications to this Agreement must be in writing and signed by both parties.
9.2. Entire Agreement: This Agreement constitutes the entire understanding between the parties.
Acknowledgment
By submitting your application, you agree to these Terms and Conditions in full. Failure to comply may result in disqualification or removal from the Festival without a refund.
